Enrolment Terms and Conditions


By enrolling the named child or children, you, as the parent, guardian and/or the person with authority and/or responsibility over the enrolled child or children, understand, agree with and consent to the following terms and conditions made with Energise Education Pty Ltd trading as Mathstar (ABN: 14 686 457 063), herein referred to as “Mathstar”, that:

General
1)    These terms and conditions, and these terms and conditions alone, will govern both your relationship, and the relationship of the enrolled child or children with Mathstar.

2)    These terms and conditions may be subject to change and/or be varied at any point in time.  Should this be the case, Mathstar will notify you of any substantial/significant changes and/or variations in writing as soon as possible.

Tuition Fees and Payment of Tuition Fees

3)    You will pay the quoted tuition fees in advance of the enrolled child or children’s first class per term.

4)   Mathstar has the right to refuse to offer tuition to the enrolled child or children should you fail to pay the quoted tuition fees in advance.

Non-Attendance

5)    All pre-paid tuition fees are non-refundable in the event that the enrolled child or children fail to attend their pre-paid and scheduled class. Mathstar will endeavour to schedule a catch-up lesson where possible, subject to availability, but there is no guarantee that a catch-up lesson will be scheduled.

​6)    You understand that it is your responsibility to ensure that the enrolled child or children attend his/her/their pre-paid and scheduled class.

Refund Policy
7)    All pre-paid tuition fees are subject to Mathstar’s Refund Policy, that is:

a)     All pre-paid tuition fees are non-refundable for non-attendance.
b)     All attended pre-paid sessions are non-refundable where the enrolled child or children:

i)      Leave prior to the conclusion of the pre-paid session due to sickness and/or any other reason and/or;
ii)     Fail to co-operate and learn, and/or engage in unlawful, inappropriate and/or disrespectful behaviour during the pre-paid session.

c)     All attended pre-paid sessions are non-refundable where the enrolled child or children are unable to receive tuition services for circumstances outside of Mathstar’s control, eg. in cases of natural disasters and/or emergencies, enforced evacuations etc.

d)     All pre-paid sessions that are cancelled by Mathstar will be fully refundable. Mathstar will seek to ensure that all pre-paid sessions and scheduled sessions are run, but this may not always be possible due to circumstances outside of Mathstar’s control.

8)    Pre-paid tuition fees are made on a per-child basis and that no pre-paid tuition fees will be transferable to another child.

9)    The tuition fees may be subject to change and/or be varied at any point in time.  Should this be the case, Mathstar will notify you of any changes and/or variations in writing as soon as possible.


TUITION AND RESPONSIBILITY FOR LEARNING
10)    Mathstar’s services are dynamic and variable, and that the nature of the tuition offered to the enrolled child or children will be dependent on a number of factors, including but not limited to the tutor’s observed needs of the enrolled child or children.

​11)    Mathstar will endeavour to assist the enrolled child or children to progress and improve academically, but cannot and does not guarantee improved academic results and/or academic achievements and/or entry into any selective school/program through its tuition services.  You understand that there are a significant number of factors which impact on the progress and improvement of the enrolled child and children’s academic results and/or academic achievements and/or entry into any selective school/program.

​12)    Mathstar will where appropriate, provide the enrolled child or children with homework to reinforce his/her/their learning.  Although the tutors at Mathstar will encourage the enrolled child or children to complete their homework, it is outside of Mathstar’s responsibility to ensure that this happens.

​13)   Mathstar’s tutors will correct homework that has been submitted to them by the enrolled child or children within a reasonable timeframe. Mathstar’s tutors are not expected to nor required to correct any homework that has been submitted to them more than two weeks from the date it was initially provided to the enrolled child or children.

CONDUCT AND BEHAVIOUR AND DAMAGE TO PROPERTY
14)    Mathstar will require that the enrolled child or children behave lawfully, appropriately and respectfully during their tuition session towards their tutor and other children within their session and tuition centre.  Should the enrolled child or children fail to behave lawfully, appropriately and respectfully during their tuition session towards their tutor and/or other children within their session and tuition centre, they will be removed from their tuition session and asked to sit at reception until they are picked up and/or the conclusion of their tuition session.

​15)    Mathstar may unenrol the enrolled child or children from any further tuition session should the enrolled child or children fail to modify and/or rectify their behaviour by their subsequent tuition sessions.

​16)    Mathstar will require that the enrolled child or children take appropriate care of and refrain from damaging Mathstar’s premises, resources and furniture.  Should the enrolled child or children recklessly, intentionally and/or maliciously damage Mathstar’s premises, resources and/or furniture, you understand that you will be held responsible for the costs of repairing and/or replacing the relevant parts of the premises, resources and/or furniture.

​17)   Mathstar will not be held responsible or liable for any damage to and/or loss of any property brought into Mathstar’s premises by the enrolled child or children.  It is the preference of Mathstar that children do not bring valuable property into their tuition sessions.

​18)    The enrolled child or children will not bring any dangerous goods or substances onto the Mathstar premises.

HEALTH AND SAFETY AND INDEMNITY
19)    You are responsible for informing Mathstar regarding any medical condition and/or illness that requires any specific medical or like treatment regarding the enrolled child or children.  Mathstar will not be able to provide any medical or like treatment, but will inform you as soon as possible should the enrolled child or children require medical or like treatment.  In cases of emergencies, Mathstar will contact “000” for assistance.  You understand that you will be fully responsible and liable for all medical and like expenses incurred in the monitoring and/or treatment of the enrolled child or children.

​20)    You are responsible for ensuring the health and safety of the enrolled child or children prior to and after his/her/their scheduled tuition sessions.  You are responsible for ensuring that the enrolled child or children are dropped-off and picked-up on time and by the appropriate person.  Mathstar will not be responsible for the health and safety of the enrolled child or children before and after their scheduled tuition sessions, and/or responsible and liable for ensuring that the enrolled child or children will be dropped-off and picked-up on time and by the appropriate person.

​21)    Mathstar will endeavour to ensure that the enrolled child or children does not leave prior to their scheduled session concluding, and will only permit the enrolled child or children from leaving prior to their scheduled session with your prior written and/or verbal consent, and/or the written and/or verbal consent from another parent and/or guardian of the enrolled child or children.

​22)   Mathstar will endeavour to provide a healthy and safe environment for learning for the enrolled child and children.  However, Mathstar is not responsible or liable for any natural disasters, accidents, injuries, deaths, losses, damages, expenses or liabilities that are sustained and/or incurred by the enrolled child or children other than that imposed by law during our tuition sessions and/or on or around our premises.

​23)   Mathstar will be released from any indemnity for any claim or action brought against Mathstar by the enrolled child or children, on behalf of the enrolled child or children, family members of the enrolled child or children and/or any other party related to or connected with the enrolled child or children arising out of the natural disasters, accidents, injuries, deaths, losses and/or damages other than that imposed by law.

INFORMATION
24)    All of the information that you have provided within the enrolled child or children’s Enrolment Form and to Mathstar is true, correct and can be relied upon.

​25)    You are required to inform Mathstar should any of your contact details and other important details regarding the enrolled child and children change.

​26)   Mathstar is free to use the information that you have provided for the purposes of:

a)    enrolling the named child or children for tuition at Mathstar;
b)    informing you of any changes to the enrolled child or children’s enrolment and/or sessions;
c)    contacting you for the purposes of obtaining general consent, authority, advice and/or information;
d)    contacting you in cases of emergencies and/or to seek medical instruction, advice and/or attention;
e)    providing updates regarding the progress of the enrolled child or children’s tuition;
f)    providing updates regarding the operations of Mathstar and;
g)    any other purpose that is deemed necessary or relevant to the provision of Mathstar’s services.
